RESPONSIBILITY FOR BANKS ADJACENT TO HIGHWAYS

Worldham Parish Council wishes to point out the following in a year of lush growth
of vegetation:
The legal situation with regard to banks adjacent to highways is that if a bank exists
along a boundary, then whoever derives support from the bank also owns it – and
has responsibility for it. Thus, where there is a bank that rises from a highways
or footway to the boundary of a field or garden, then the owner of that land is also
responsible for the maintenance of the bank. Conversely, if a bank supports a road,
then the highway authority is responsible for the maintenance of the bank.
So a polite notice to parishioners – please would you cut back all vegetation that
overhangs or in other ways obstructs the footpaths and roads of the parish.
